THIRD STATEMENT OF THOMAS MOORE, DEFENDANT/APPLICANT





  1. I am the Defendant, Thomas Moore, unemployed, of 1 Pares Land Walk, Rochdale OL16 5SX.

  2. I am compiling this statement in the way I have seen compiled statements for civil Claims.

  3. I do not know how to compile statements for litigation properly. I apologise for any inconvenience.

  4. I make this statement in support of my application that all prosecution witnesses be required to attend and give oral evidence, which is attached to this statement.

  5. I am making this application in the hope that those involved will permit me proper legal representation, and to keep the option open for such representation.

  6. Since this prosecution began, Bolton Crown Court has failed to reply to my correspondence, Rochdale Magistrates Court has harassed me, and the Crown Prosecution Service refused to reply to most of my letters.

  7. I ask that you all observe your obligations under the Criminal Procedure Rules in particular number one.

  8. Further, I ask that if you believe I am or may be failing in my obligations, that you tell me promptly, in writing and using clear English.

  9. On the directions for case committed to Crown Court, the Clerk to the Justices at Rochdale Magistrates Court responds to question number three, "what pleas, if any, are indicated," with "none." This may be incorrect.

  10. I attended Rochdale Magistrates Court on 30 March 2007, as directed although I was late.

  11. The Learned Judge said that because I was unable to give a plea, he was entering a plea of not guilty.

  12. Solicitors Healy Connor Mulchahy wrote to me imposing their own not guilty plea.

  13. The prosecuting solicitor said that trial in the Magistrates Court would not be available to me in any event.

  14. I have subsequently indicated to Rochdale Magistrates Court that I expect its recording of the 30 March 2007 hearing is no longer available.

  15. Rochdale Magistrates Court has written to me stating it determined to decline jurisdiction and pass the matter to the Crown Court.

  16. I believe the actions of officers of Rochdale Magistrates Court I outline above were wrong in law.

  17. I therefore humbly ask the court to grant the relief I seek.
