FIRST STATEMENT OF THOMAS MOORE, CLAIMANT DEFENDANT
- I am Thomas Moore, unemployed, of 1 Pares Land Walk, Rochdale.
- I make this statement in support of my appeal to the extent of giving the Court some essential documents, and state, for absolute clarity, some obvious and well known facts.
- Exhibit TM/01/01 is my most recent evidence of income, in support of Court Fee exemption.
- Exhibit TM/01/02 is the covering letter from Michelle Crabbe, dated 16 August 2007, which enclosed your Court's Order of 15 August 2007. Michelle Crabbe has history of venting her personal hatred on me.
- Exhibit TM/01/03 is the Court's Orders of 15 August 2007.
- Despite the remark on page 3 of this Order, about having notice, I received no notice of the hearing of 15 August 2007.
- I have not received any Claim Particulars for this Claim.
- I wrote to the Court asking about the Claim, because the Claimant will never tell me, and the Court replied, on 12 June 2007, Exhibit TM/01/05, and 25 July 2007, Exhibit TM/01/06.
- In respect of the Claim Particulars, I appear to be in the same position as the Court, which records on page three of its Order, that the Claimant gave no oral and no written evidence.
- I fail to see how the Court, having not seen or heard any of the Claimant's evidence, can assume the precise opposite of the truth, despite my asking about this Claim on 7 June 2007 and 19 July 2007.
- The Claimant has no right to its Orders and I ask that those Orders be revoked immediately.
- With regard to any complaints the Claimants may have, they can write to me, and I will respond as best I can.
- The Claimant knows I will do my best to avoid yet more rounds of its harassing litigation.
- Exhibit TM/01/04 is my hand delivered letter of 4 June 2007 asking if the Claimant wanted me to contact Michelle Crabbe or if the Claimant was litigating again, and to be told of all the Claimant's Court applications where I am a party.
- As usual, the Claimant did not reply to my 4 June 2007 letter.
- Part of the Rochdale Metropolitan Borough Council "gesture of good will" referred to in my letter of 4 July 2007, is reproduced in Exhibit TM/01/07.
- The Claimant subjects me to "gestures of good will" like that, on a daily basis.
- The Claimant is depriving me of a private life contrary to the European Convention Article 8, because I have to spend time responding to its at least twice yearly Claims, often using proxies, in various Courts.
- Since the start of my current tenancy, the Claimant has not executed one repair to my home properly, but the Claimant has vandalised my home, often excused by reference to the Health and Safety at Work Act.
- The Claimant is still blocking my access to legal services.
- I cannot instruct solicitors. Rarely, solicitors, such as June Kelly of Williscroft & Co. in Bradford, and Sarah Bartram of Parker Bird Whiteley in Ashton, agree to be appointed, but they never do anything for me.
- I want a good relationship with the Claimant.
- I therefore humbly ask the court to grant the relief I seek.
